General Terms and Conditions

1. General
   All offers from fastplay.ch are made on the basis of the following terms and conditions. These form the basis of all offers and agreements and are considered accepted for the duration of the entire business relationship upon placing an order or accepting delivery. Deviating conditions that are not expressly acknowledged in writing are non-binding for us, even if they have not been explicitly contradicted. The invalidity of individual provisions does not affect the validity of the remaining provisions.

2. Conclusion of Contract
   The contract is concluded upon confirmation of the order when we accept the order by delivering the goods or by notifying the shipment.

3. Prices
   For orders in our online shop, the prices listed at the time of the order apply. The stated prices are final prices, including the applicable statutory VAT and other price components. Any promotions cannot be combined with other discounts.

4. Payment / Delivery
   We primarily deliver within Switzerland and only while stocks last. The stated shipping flat rates apply only to deliveries within Switzerland (CHF 10, free delivery for orders over CHF 200).
   For deliveries to the EU and other EFTA countries (excluding CH), different shipping flat rates apply: CHF 45 for packages up to 2 kg, CHF rates for packages up to 5 kg, and for larger packages, shipping costs will be announced upon request. Deliveries abroad are made exclusively on prepayment. Any customs duties are the responsibility of the buyer.
   We do not assume any procurement risk. We are only obliged to deliver from our stock and from the goods ordered from our suppliers. Our obligation to deliver ceases if, despite a proper congruent cover transaction, we ourselves are not properly and timely supplied, and we are not responsible for the unavailability, provided we inform you immediately and have not assumed any procurement risk. In case of non-availability, any advance payment will be refunded immediately. Delivery time is reasonably extended in case of circumstances beyond our control (force majeure). Start and end of such obstacles will be communicated immediately. If the obstacle lasts more than 4 weeks beyond the originally applicable delivery times, you are entitled to withdraw from the contract. No further claims, especially for damages, exist.
   Payment can be made by bank transfer, postal payment, or PayPal. We reserve the right to exclude certain payment methods in individual cases. If you are in default of payment, we reserve the right to charge reminder fees.

5. Redeeming Gift Vouchers for Fastplay Items on www.fastplay.ch
   Gift vouchers (purchased by you) can be redeemed for Fastplay items and partner items only on www.fastplay.ch and/or at the Horw branch by providing the voucher number. They cannot be used to purchase additional gift vouchers. The balance of a gift voucher will not be paid out in cash or accrue interest. We are not liable in case of loss, theft, or illegibility of the voucher not caused by us. The gift voucher is transferable. Use of vouchers for commercial purposes is not permitted. Copying, editing, or manipulating vouchers is also not permitted.

6. Right of Return
   All items can be returned within 10 days of receipt without giving a reason. The return shipping costs are borne by the customer. If the returned goods show signs of use or damage, we reserve the right to claim compensation.

7. Retention of Title
   The goods remain our property until full payment has been made.

8. Data Protection
   The personal data of the customer, such as name, address, and telephone number, are stored and treated confidentially. Data will not be passed on to third parties unless necessary for the order and its processing. By placing an order, the customer agrees to the storage of their personal data.

9. Applicable Law, Jurisdiction – Place of Performance
   The place of performance for both parties is Lucerne. The ordinary courts of Lucerne have jurisdiction over disputes. Swiss law applies to all legal transactions and other legal relationships with us.

10. Amendment of the General Terms and Conditions
    We are entitled to unilaterally amend these General Terms and Conditions, as far as they are incorporated into the contractual relationship with the customer, to correct subsequent equivalence disturbances or to adapt to changed legal or technical conditions.

11. Severability Clause
    Should individual provisions of the contract, including these regulations, be wholly or partially invalid or should the contract contain an unforeseen gap, the validity of the remaining provisions remains unaffected. The respective statutory provisions shall replace the invalid or missing provisions.
